Terms of Service

Last updated: 11 September 2026

1. Who these terms are with

These terms apply to services provided by PC Madness Pty Ltd (ABN 69 116 156 926), trading as PC Madness Web Services, of 2C Stafford Street, Midland WA 6056.

Your specific written quote or service agreement takes precedence over anything on this page. This exists so you can read the general arrangement before committing to a project.

2. Quotes and scope

Website quotes are fixed-price and itemised. The quote states the number of pages, what is included, and what is not. A quote is valid for 30 days.

If you ask for something outside the agreed scope during the build, we will quote it separately and you approve it before we do the work. We do not add charges after the fact.

3. Payment

Website projects: 50% deposit to book the work in, 50% on completion before the site goes live. Larger platform builds may be split across agreed milestones instead.

Ongoing services (hosting, local SEO) are billed monthly in advance and are month-to-month unless agreed otherwise. No lock-in contracts.

Payment plans: on projects from $4,000 you can pay monthly over a fixed term instead of paying up front. The monthly covers the build and Standard Care hosting for the whole term. There is no interest, no establishment fee and no credit check, and the total payable across the term is stated in your quote before you agree to it.

A payment plan is a fixed term, not a month-to-month service. You are agreeing to the full term when you sign. Payments are invoiced from Xero and collected by direct debit or card; the Direct Debit Request Service Agreement we issue sets out the amount, the dates, how to defer or alter a payment, how to dispute one, and what happens if a payment fails. We give at least 14 business days’ notice before the first debit and before any change to the amount or the date.

If a payment fails we will contact you before trying again. Any dishonour cost charged to us by the bank is passed on at cost and nothing is added to it.

All prices include GST. Invoices are payable within 7 days unless stated otherwise on the invoice.

4. What you own

Once your project is paid in full, you own the design, the content and the code we produced for you, outright. It is yours to take elsewhere, modify, or have someone else maintain.

Your domain is registered in your name and you control it. Third-party components (fonts, libraries, stock imagery) remain under their own licences, which we will tell you about where relevant.

We keep the right to describe the work publicly and show it in our portfolio, unless you ask us not to — just say so and we will not.

5. What we need from you

Projects need content: text, photos, logos, and answers to questions about your business. If you are supplying those, delays in providing them move the timeline.

You confirm you have the right to use any content you give us. We cannot verify the ownership of images or copy you supply.

6. Timelines

Any timeline we quote is a working estimate based on prompt feedback and content. They are not guarantees, and the most common cause of delay is waiting on material from the client.

If a project stalls on your side for more than 60 days, we may invoice for work completed to date and reschedule the remainder.

7. Revisions

Website projects include two rounds of revisions on the design before build, and one round after. Further changes are quoted separately.

A "round" means consolidated feedback given at once, not individual changes requested over several weeks.

8. Hosting and ongoing services

Hosting is billed monthly and includes what is listed on the hosting page. Either side can end it with 30 days’ notice.

The exception is hosting bundled into a payment plan. That is part of the fixed term and is not separately cancellable while the plan is running — it ends when the plan does, and you can move the site anywhere you like once it is paid out.

If you leave, we will provide a full export of your site and database. We do not hold sites hostage.

Our SEO performance guarantee has its own terms on the guarantee page.

9. Cancellation

If you cancel a project after work has started, the deposit covers work completed to that point. If work completed exceeds the deposit, we invoice the difference; if it is less, we refund the balance.

We may decline or end a project if the work turns out to be materially different from what was described, or if the working relationship is not viable. In that case you pay only for work completed.

On a payment plan: if you want to end it early, you pay out the remaining build amount and the site transfers to you. We will tell you that figure on request and it does not change based on when you ask. Care and hosting stop at the same time and are not charged beyond the month you exit.

If payments stop without an agreed payout, the site and its hosting may be suspended until the account is brought up to date. We will contact you first. We do not delete anything, and a full export of your site and database is available to you either way.

10. Liability

Our services come with guarantees under the Australian Consumer Law that cannot be excluded, and nothing here limits them.

Beyond those rights, our liability for any claim is limited to the amount you paid us for the service in question. We are not liable for indirect or consequential loss such as lost profits or lost business.

We take reasonable care with backups and security, but we cannot guarantee any website is immune from downtime or attack. That applies to everyone; anyone claiming otherwise is overselling.

11. Privacy

How we handle personal information is set out in our privacy policy.

12. Governing law

These terms are governed by the laws of Western Australia.
